These Terms of Service (“Terms”) govern your use of 805 Coast Media’s website and services, including website design, development, hosting, custom web applications, and ecommerce platforms.

Scope of Services

We provide services that may include website design, development, hosting, maintenance, SEO-related implementation (non-guaranteed), custom web applications, integrations, and ecommerce builds. Specific deliverables, timelines, and pricing are defined in your proposal, order form, or written agreement.

Plans, Billing, and Minimum Terms

If you are on a monthly plan (including “$0 down” offers), a 12-month minimum term may apply unless otherwise stated in writing.

  • Monthly fees are billed in advance unless otherwise agreed.
  • Late payments may result in paused work, suspended support, or temporary service interruption.
  • One-time projects may require deposits and milestone payments as defined in the proposal.

Client Responsibilities

To deliver your project, you agree to provide timely access and materials, including:

  • Accurate business information, content, images, logos, and brand assets (or approval for us to use stock assets).
  • Required access to domains, DNS, hosting accounts, analytics, and third-party services.
  • Timely feedback and approvals to prevent delays.
  • Authority to publish content and represent that you have rights to all materials you provide.

Content, Copyright, and Licensing

You retain ownership of content and assets you provide. You grant us a license to use those materials solely to deliver and support your project.

If we provide stock images, fonts, plugins, or third-party tools, they may be subject to separate licenses and usage restrictions.

Hosting, Maintenance, and Support

If hosting/support is included in your plan, we will provide reasonable operational support, updates, and maintenance consistent with your agreement. “24/7 support” means availability to receive requests at any time, but response and resolution times can vary based on severity and workload.

We do not guarantee uninterrupted service. Planned maintenance, provider outages, internet routing issues, and circumstances beyond our control may impact availability.

Unlimited Edits (If Included)

“Unlimited edits” covers reasonable content and layout edits within the existing site structure (text updates, image swaps, basic page changes). It does not include unlimited new pages, major redesigns, new features, complex integrations, or net-new custom application development. Those items may require a separate scope and fee.

Ecommerce and Third-Party Services

Ecommerce builds may depend on third-party providers (payment processors, shipping/tax services, platform plugins). You are responsible for third-party fees and compliance obligations (tax, refunds, required disclosures, and applicable laws).

Payment processing is handled by third-party payment processors and is governed by their terms.

SEO Disclaimer

We can implement SEO best practices (site structure, metadata, performance improvements, indexing setup), but search engine rankings and traffic are not guaranteed. Results depend on competition, content quality, business category, location, and ongoing marketing.

Revisions, Approval, and Launch

You are responsible for reviewing and approving deliverables. Launch timelines depend on receiving approvals and required access. If a project is delayed due to missing materials or approvals, we may adjust timelines accordingly.

Termination

Either party may terminate according to the applicable agreement. For monthly plans with a minimum term, early termination may require payment of remaining fees due under that term unless otherwise agreed in writing.

Upon termination, hosting/support may be discontinued, and you are responsible for transferring your domain and services if you choose to move away.

Warranty Disclaimer

Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, 805 Coast Media shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of our services. Our total liability for any claim will not exceed the amount paid to us for the services giving rise to the claim in the twelve (12) months preceding the event.

Indemnification

You agree to indemnify and hold harmless 805 Coast Media from claims arising out of your content, your misuse of the services, your violation of these Terms, or your violation of any law or third-party rights.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date above. Your continued use of our website or services after changes indicates acceptance of the updated Terms.
